2. Subscription and Payment
- Users must create an account and subscribe to access our courses.
- Subscription plans are available on a monthly and yearly basis.
- Payments are processed via PayStack using Credit Card or Instant EFT.
- No refunds are provided for subscription fees.
- Users must manually cancel their subscription at least 7 days before renewal to avoid automatic charges.
- Failure to settle outstanding subscription fees will result in automatic discontinuation of access and programme participation.
3. Scope of Practice Responsibility
- The responsibility rests solely on the subscriber (“Member”) to ensure that the information and techniques acquired through this programme align with their professional scope of practice.
- Members must verify that their professional role permits the application of the learned content within their respective fields.
- Members are required to comply with all applicable regulations and limitations governing their professional practice and are expected to act within the boundaries established by their professional bodies.
- Where a Member’s professional registration prohibits psycho-legal work, such Member is expressly prohibited from utilizing any information obtained from this programme for psycho-legal purposes or any activities beyond their defined scope of practice.
- The organisers, presenters, and affiliated parties bear no liability for any misuse, misapplication, or improper use of the information or techniques acquired during the course.
4. Intellectual Property Rights
- All intellectual property rights, including but not limited to course materials, presentations, and proprietary content, remain the exclusive property of Fact Funda Pty Ltd, the course presenter, or the relevant copyright holders.
- Members are strictly prohibited from reproducing, distributing, or using any course materials outside the scope of personal learning without obtaining explicit written consent from the course presenter.
- All materials available on the website remain the exclusive property of Fact Funda and may not be shared or redistributed.
5. Disclaimer Regarding Professional Certification
- All live training sessions and self-paced courses are registered with the South African Council for Social Service Professions (SACSSP) as part of continuous professional development (CPD).
- These courses are not registered for CPD with the Health Professions Council of South Africa (HPCSA) or any other professional body.
- Members must complete self-paced training sessions and any related evaluations within the allocated timeframe before the CPD points expire.
- Fact Funda Pty Ltd does not provide additional training resources or extensions for members who fail to complete self-paced sessions within the required timeframe.
6. Cancellation and Termination
- Members may cancel their subscription manually via their account settings.
- Failure to cancel at least 7 days before renewal will result in automatic charges for the next subscription cycle.
- Accounts found in violation of these Terms may be suspended or terminated at the sole discretion of Fact Funda.
7. Limitation of Liability
- Fact Funda Pty Ltd, its affiliates, employees, and presenters shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities.
- The Company is not responsible for technical failures, service interruptions, or payment processing errors caused by third-party service providers.
- All course content and materials are provided on an “as is” basis without warranties of any kind, whether express or implied.
- To the extent permitted by law, the total liability of Fact Funda Pty Ltd shall not exceed the amount paid for the subscription.
8. Governing Law
These Terms and Conditions shall be governed and construed in accordance with the laws of South Africa. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
